WEBSITE VISITOR CLARIFICATION TEXT ON THE PROTECTION OF PERSONAL DATA

The personal data of our website visitors will be recorded by Law No. 6698 on the Protection of Personal Data (“Law”) by Ester Clinic (from now on referred to as “Clinic”) as a data controller, in particular, the principle of protecting the privacy of private life will be classified, stored, updated and processed within the framework of the processing conditions listed in the Law, and transferred to third parties in cases and the extent permitted by the legislation.

The relevant legislation has prepared this Clarification Text in force and the rules shown in the regulations, communiqués, decisions, and guides published by the Board, particularly the Law. If there is a change in the Law or other relevant legislation after the publication date of the Clarification Text by the Clinic and the Clarification Text becomes incompatible with the said amendment, the amended provisions and rules will be applicable. The Clinic follows all communiqués, decisions and guidelines published by the Board, and the regulations stipulated by the Clarification Text are kept up to date.

4. TRANSFER OF PERSONAL DATA

Your data collected by the Clinic, within the framework of the data as mentioned earlier processing purposes and the personal data processing conditions specified in Articles 8 and 9 of the Law, with law offices, financial advisors, and other consultants to obtain legal consultancy, benefiting from storage and archiving activities and data security can be shared with companies and individuals providing information technologies, cloud, and archive services, and with authorized public institutions and organizations if requested.

5. SHARING PERSONAL DATA WITH THIRD PARTIES FOUND ABROAD

Your personal data can be shared abroad within the framework of keeping the e-mail service infrastructures of the e-mail contact addresses sent to the relevant persons in the data centers.

6. YOUR RIGHTS UNDER THE LAW

As personal data owners, you can submit your requests regarding your rights through the methods regulated in the data subject application procedure (Based on the Communiqué on Application Procedures and Principles to the Data Controller). Your identity can be confirmed in writing with another document or by using a registered e-mail (KEP) address, secure electronic signature, mobile signature, or an e-mail address previously notified to the Clinic by the person concerned and registered in the Clinic’s system. However, if the process requires a separate cost, the fee in the tariff determined by the Personal Data Protection Board will be charged by the Clinic. In this context, personal data owners have rights to;

Request information about if personal data has been processed,

Learn the purpose of personal processing data and whether they are used per its purpose,

Know the third parties to whom personal data is transferred at home or abroad,

Request correction of personal data in case of incomplete or incorrect processing and request notification of the transaction made within this scope to third parties to whom personal data has been transferred,

Request the deletion or destruction of personal data if the reasons requiring its processing cease to exist, even though it has been processed by the provisions of the Law and other relevant laws, and request that the transaction carried out in this context be notified to the third parties to whom the personal data has been transferred,

Object to the emergence of a result against the person himself by analyzing the processed data exclusively through automated systems,

Request compensation for the damage in case of loss due to the unlawful processing of personal data
